California: Barbering and Cosmetology Establishments Must Post Workplace Notice

Posting Requirement Effective July 1, 2017
Under a new law in California, beginning July 1, 2017 (upon availability of the posting notice developed by the Labor Commissioner), an establishment licensed by the Board of Barbering and Cosmetology is required to post a notice pertaining to workplace rights and wage and hour laws.
Such notice must be posted in a manner that complies with specified requirements of the California Labor Code, in a conspicuous location in clear view of employees and where similar notices are customarily posted. The notice must be posted in English, Spanish, Vietnamese, and Korean.

It is expected that the required notice include information about the following topics:
- Misclassification of an employee as an independent contractor.
- Wage and hour laws (e.g., minimum wage, overtime compensation, meal periods, and rest periods).
- Tip or gratuity distribution.
- How to report violations of the law.
- Business expense reimbursement.
- Protection from retaliation.
Covered establishments must display the poster beginning July 1, 2017, upon the availability of such notice. The Labor Commissioner is expected to create a notice that complies with the law. Click here to read the text of the law.
