San Francisco: Paid Parental Leave Ordinance Poster and Other Resources Now Available

New San Francisco Paid Sick Leave Poster Also Available

The San Francisco Office of Labor Standards Enforcement (OLSE) has released, along with additional compliance resources, the required poster that covered employers must display under the Paid Parental Leave Ordinance (PPLO). A new San Francisco Paid Sick Leave poster is also available.

Background
Effective as of January 1, 2017, the PPLO requires San Francisco employers with 50 or more employees to provide partial wage replacement to covered employees taking leave to bond with a new child under the California Paid Family Leave program. It requires such employers to supplement the California Paid Family Leave weekly benefit amount that the employee receives by paying the employee "Supplemental Compensation" in an amount such that the total of the California Paid Family Leave compensation the employee receives and the Supplemental Compensation provides, but does not exceed, 100% of the employee's current normal gross weekly wage.

On July 1, 2017, the ordinance's partial wage replacement requirement expands to employers with 35 or more employees, and on January 1, 2018, to employers with 20 or more employees.

New PPLO Compliance Resources
The following new resources may be of interest to employers in San Francisco:

  • PPLO Poster. Covered employers must post the required PPLO poster at every work place and job site. The poster should be printed on 8.5" x 14" paper.
  • PPLO Rules. The OLSE has recently released rules to implement the PPLO.
  • Paid Parental Leave Form. Covered employers must provide the Paid Parental Leave Form to employees in San Francisco, and employees must complete the form and submit it to their employers to receive Supplemental Compensation.
  • Calculation Instructions. The OLSE provides step-by-step instructions on calculating the amount of Supplemental Compensation that a covered employer must pay to a covered employee.

New San Francisco Paid Sick Leave Poster
Employers must provide paid sick leave to each employee (including temporary and part-time employees) who performs work in San Francisco. The OLSE, in consultation with the State of California Department of Industrial Relations, has released a new San Francisco Paid Sick Leave poster. Every employer must post the notice in a conspicuous place at any workplace or job site where any employee works.

This official poster satisfies the notice posting requirements of both the local San Francisco Paid Sick Leave Ordinance and the statewide California Healthy Workplaces, Healthy Families Act for workplaces in San Francisco.
