IRS Video Promotes Voluntary Classification Settlement Program

Eligible Employers Allowed to Reclassify Workers
The IRS has released a video highlighting features of its Voluntary Classification Settlement Program. The program allows eligible employers to reclassify their workers as employees for future tax periods, with partial relief from federal employment taxes.
To be eligible for the program, an employer must:
- Have consistently treated the workers to be reclassified as independent contractors or other nonemployees, including having filed all required Forms 1099 for the workers for the previous three years.
- Not currently be under employment tax audit by the IRS.
- Not currently be under audit by the Department of Labor (DOL) or a state agency concerning the workers' classification.
- Have complied with the results of any previous IRS or DOL audit concerning the classification of the workers.
