Connecticut Enacts Law Regarding Support Orders and Workers' Compensation

Law Effective January 1, 2018

A new law in Connecticut requires employers whose employees are subject to a support order to take additional steps when such employees make claims for workers' compensation benefits.

Under the new law, when an employee makes a claim for workers' compensation benefits, employers must include a copy of any withholding order received by the employer with its first report of occupational illness or injury to its workers' compensation carrier.

Note: The carrier must withhold funds pursuant to the order and pay the withheld funds as required by state law (section: 52-362(f)).

Under state law, when an employee under a support order makes a claim for workers' compensation, his or her employer must promptly notify the dependent (i.e., spouse, former spouse, or child owed the support) or the Judicial Branch's Support Enforcement Services as directed.
